A couple is taking action against Thomson Holiday after becoming ill in Torremolinos

Two more holidaymakers claim to have fallen ill at a Spanish hotel at the centre of a £2.5 million compensation payout to British tourists.

Charles Fish, 63, and his wife Ann, 61, from south London, have started legal proceedings against Thomson Holidays, who organised their holiday to the Beach Club Hotel in Torremolinos last month.

Their case comes just three months after the multi-million pound payout to hundreds of holidaymakers who became ill during stays at the same hotel between 2000 and 2003 was completed.

Law firm Irwin Mitchell, who acted in the original case and are representing Mr and Mrs Fish, said the couple fell ill within a few days of arriving at the hotel.

They both claim to have suffered severe diarrhoea, abdominal pain and vomiting. Mr Fish was admitted to hospital on April 14 and remained there for four days, Irwin Mitchell said.

The couple reported poor hygiene at the hotel, including undercooked food left out for long periods.

Many hotel guests in the original claim contacted norovirus, while others were struck down by salmonella and campylobacter.

Five tour operators settled more than 200 claims in out-of-court settlements several years ago.

Thomson and Thomas Cook offered an out-of-court settlement at the end of last year and a court approved terms in February. The hotel owners also contributed to the package.

The total sum is the UK's largest successful compensation claim for norovirus.
